1. Acceptance of Terms

By downloading, installing, or using HeartLab ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and HeartLab ("we," "us," or "our") regarding your use of the App.

2. Description of Service

HeartLab is a mobile application that:

• Imports and visualizes ECG data from Apple Watch via Apple HealthKit
• Provides analysis and metrics derived from ECG recordings
• Offers educational information about heart health
• Includes an AI assistant for informational purposes
• Provides wellness features including breathing exercises and mood tracking
• Generates PDF reports for sharing with healthcare professionals

3. Medical Disclaimer

3.1 Not a Medical Device

HeartLab is NOT approved or certified as a medical device by any regulatory authority (including the FDA, CE, or equivalent). The App is intended for general wellness and informational purposes only.

3.2 No Medical Advice

The information, analysis, and insights provided by HeartLab:

• Are NOT medical diagnoses
• Should NOT be used to make medical decisions
• Do NOT replace professional medical advice, diagnosis, or treatment
• Are NOT intended to diagnose, treat, cure, or prevent any disease

3.3 Consult Healthcare Professionals

You should ALWAYS:

• Consult a qualified healthcare professional for any health concerns
• Seek immediate medical attention for chest pain, shortness of breath, or other cardiac symptoms
• Not delay seeking medical care based on information from the App
• Discuss any ECG findings with your doctor

3.4 Emergency Situations

HeartLab is NOT designed for use in medical emergencies. If you are experiencing a medical emergency, immediately call your local emergency services:

• Europe: 112
• Italy: 118
• United Kingdom: 999

4. Eligibility

To use HeartLab, you must:

• Be at least 17 years of age
• Own an iPhone with iOS 17 or later
• Have an Apple Watch with ECG functionality (for ECG features)
• Have the legal capacity to enter into these Terms

5. Account Registration

Some features of the App require account registration. When creating an account, you agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscriptions and Payments

6.1 Free and Premium Features

HeartLab offers both free and premium (paid) features. Premium features require an active subscription.

6.2 Subscription Plans

We offer the following subscription options:

• Premium Monthly: €14,99/month, billed monthly
• Premium Annual: €49,99/year, billed annually

Prices may vary by region and are subject to change.

6.3 Billing

Subscriptions are processed through Apple's App Store. By subscribing, you agree to:

• Apple's App Store Terms and Conditions
• Automatic renewal of subscriptions until cancelled
• Payment through your Apple ID account

6.4 Cancellation

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

6.5 Refunds

Refund requests must be made through Apple. We do not directly process refunds. Apple's refund policies apply.

7. User Conduct

When using HeartLab, you agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App to infringe on any third-party rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Use the App to provide medical services or advice to others
• Share your account credentials with others

8. Intellectual Property

8.1 Our Rights

HeartLab and all its contents, including but not limited to:

• Software code and algorithms
• User interface and design
• Trademarks and logos
• Documentation and content

are owned by HeartLab or its licensors and are protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8.3 Your Content

You retain ownership of any content you create within the App (such as journal entries or notes). By using the App, you grant us a limited license to process this content as necessary to provide the Service.

9. Privacy

Your use of HeartLab is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Third-Party Services

HeartLab integrates with third-party services including:

• Apple HealthKit: For ECG data access
• OpenAI: For AI assistant functionality
• RevenueCat: For subscription management
• Supabase: For authentication and data storage

Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
• We do not warrant that the App will be uninterrupted, error-free, or secure
• We do not warrant the accuracy, completeness, or reliability of any analysis or information

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• HeartLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
• We are not liable for any health outcomes, medical decisions, or consequences arising from use of the App
• We are not liable for any third-party actions or services

13. Indemnification

You agree to indemnify and hold harmless HeartLab, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any medical decisions made based on information from the App

14. Modifications to the Service

We reserve the right to:

• Modify or discontinue any feature of the App at any time
• Update these Terms with reasonable notice
• Change subscription prices with 30 days notice

Continued use of the App after changes constitutes acceptance of modified Terms.

15. Termination

We may terminate or suspend your access to the App:

• For violation of these Terms
• For illegal or fraudulent activity
• At our discretion with reasonable notice

Upon termination, your license to use the App ends immediately. Provisions that should survive termination (such as disclaimers and limitations of liability) will remain in effect.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Rome, Italy, unless otherwise required by applicable consumer protection laws.

17. Dispute Resolution

Before initiating any legal proceeding, you agree to attempt to resolve any dispute informally by contacting us at hello@heartlab.it. If informal resolution fails after 30 days, either party may proceed with formal dispute resolution.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and HeartLab regarding the App and supersede any prior agreements.
